By accessing or using Finance Forecaster, you confirm that:

2.1 Core Services

Finance Forecaster provides AI-powered financial management tools including:

• AI-Powered Insights: Personalized financial advice and recommendations
• Account Aggregation: Secure connection to bank accounts via Plaid
• Budget Management: Tools for creating and tracking financial budgets
• Goal Tracking: Features to set and monitor financial objectives
• Transaction Analysis: Categorization and analysis of financial transactions

2.2 Service Availability

We strive to provide continuous service availability but cannot guarantee uninterrupted access. Service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical difficulties
• Third-party service interruptions
• Circumstances beyond our reasonable control

3. User Accounts and Registration

3.1 Account Creation

To use Finance Forecaster, you must create an account by providing:

• Valid email address
• Secure password meeting our requirements
• Accurate personal information

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Financial Data and Third-Party Services

4.1 Plaid Integration

Finance Forecaster uses Plaid Inc. to securely connect to your financial institutions. By using our service, you also agree to Plaid's Terms of Service and Privacy Policy:

4.2 Financial Institution Access

You authorize us to:

• Access your financial account information through Plaid
• Retrieve and analyze your transaction data

While we strive for accuracy, we cannot guarantee that:

• All financial data is complete or error-free
• Third-party data sources are always accurate
• Real-time data is available from all institutions
• Categorizations are always correct

5. Prohibited Uses

You agree NOT to use Finance Forecaster for:

5.1 Illegal Activities

• Any unlawful purpose or activity
• Money laundering or terrorist financing
• Fraud, identity theft, or financial crimes
• Violation of any applicable laws or regulations

5.2 Prohibited Technical Activities

• Attempting to gain unauthorized access to our systems
• Reverse engineering, decompiling, or disassembling our software
• Using automated tools to access our service (bots, scrapers, etc.)
• Interfering with the proper functioning of our service
• Transmitting viruses, malware, or malicious code

5.3 Commercial Restrictions

• Reselling or redistributing our service
• Using our service for commercial purposes without written consent
• Creating derivative works based on our service

6. Pricing

Finance Forecaster is currently offered free of charge. We may introduce paid plans in the future. If we do, we will give you advance notice, post updated terms describing billing, cancellation, and refund rules, and — where required by law — obtain your consent before charging you. Using any new paid plan will be optional.

7. Intellectual Property Rights

7.1 Our Rights

Finance Forecaster and all related content, including but not limited to:

• Software, algorithms, and source code
• User interface designs and graphics
• Trademarks, logos, and branding
• Documentation and help materials

Are owned by us and protected by intellectual property laws.

7.2 Your Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use Finance Forecaster for your personal financial management.

7.3 User Data

You retain ownership of your personal and financial data. You grant us a license to use your data solely for providing and improving our service as described in our Privacy Policy.

8. Disclaimers and Limitations

8.2 Service Disclaimers

Finance Forecaster is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including:

• Accuracy: We do not warrant that forecasts or analyses will be accurate
• Completeness: Financial data may be incomplete or delayed
• Reliability: Service availability is not guaranteed
• Security: While we implement strong security measures, no system is 100% secure

8.3 Limitation of Liability

To the maximum extent permitted by law, Finance Forecaster shall not be liable for:

• Direct Damages: Any direct financial losses
• Indirect Damages: Consequential, incidental, or punitive damages
• Lost Profits: Any lost business opportunities or profits
• Data Loss: Loss or corruption of your data
• Third-Party Actions: Actions of financial institutions or other third parties

Maximum Liability: Our total liability shall not exceed the amount you paid for the service in the 12 months prior to the incident.

You agree to indemnify and hold harmless Finance Forecaster from any claims, damages, or expenses arising from:

• Your use or misuse of our service
• Your violation of these Terms
• Your violation of any applicable laws
• Your infringement of third-party rights

10. Privacy and Data Protection

11. SMS Messaging

11.1 Opt-In

Finance Forecaster offers an optional SMS Assistant. To opt in, you must enter your mobile number in the Finance Forecaster mobile app and confirm ownership by entering a one-time verification code we send to that number. Tapping "Send verification code" in the app is your consent to receive SMS from us. We do not collect phone numbers for SMS through any other channel.

11.2 Message Frequency and Rates

Message frequency varies based on how often you choose to text the assistant. Usage is capped at up to 30 messages per hour and 100 messages per day per user. Message and data rates may apply. Standard messaging rates from your wireless carrier apply to messages sent and received.

11.3 STOP and HELP

You can stop receiving SMS at any time by replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any message. You can request help by replying HELP or INFO. We will reply with a confirmation in each case and honor your request immediately.

11.4 Phone Number Handling

Your phone number and SMS conversation contents will not be shared with or sold to third parties for marketing or other promotional purposes. We use your number solely to deliver the verification code, send replies to messages you initiate with the assistant, and honor STOP / HELP keyword requests as required by U.S. carrier regulations. Mobile carriers are not liable for delayed or undelivered messages.

12. Modifications to Service and Terms

12.1 Service Changes

We may modify, suspend, or discontinue any aspect of Finance Forecaster at any time. We will provide reasonable notice of material changes when possible.

We may update these Terms periodically. We will notify you of material changes by:

• Email notification
• In-app notification
• Posting updated terms on our website

Continued use of our service after changes constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution
